2.- INTELLECTUAL & INDUSTRIAL PROPERTY RIGHTS
IBERCLEAR is the title-holder to all intellectual or industrial property exploitation rights relating to IBERCLEAR.ES & IBERCLEAR.COM, as well as being the holder, or has the corresponding license of the industrial, intellectual rights of property, and of image of the available content of the said websites but excludes the rights on products or services that are not property of IBERCLEAR, whose products are registered in favour of its respective holders, and remain recognised by IBERCLEAR.
In no case will be understood that the access and navigation of the User, implies a renunciation, transmission, authorisation of use, license, either total or partial transfer of said rights on the part of IBERCLEAR.
Consequently, it is explicitly prohibited to modify, copy, reuse, exploit, reproduce, transform, distribute, communicate publicly, offer availability of, extract, create copies or subsequent publications, change files, transmit electronically, use, treat by means of any additional procedure the totality or part of the contents included in IBERCLEAR.ES & IBERCLEAR.COM for purposes public or commercial, except in cases which are legally permitted, or where the express written authorisation of IBERCLEAR or, in the case of the holder of the rights to which it correspond, has been obtained.
The User should refrain from obtaining, or to try to obtain, the contents of the website by different media other than those provided for the explicit use of the Internet (and provided that those media forms do not pose a risk of damage or result in the misuse of the website, compromise security or lead to a Denial of Service). The authorisation granted to use the website will be understood to be automatically terminated if an infringement of any of these conditions occurs, and will result in the User being obliged to destroy immediately any material obtained or printed from the website.

LINKS: It is necessary to obtain prior authorisation in writing from IBERCLEAR to establish a link, from other places or web pages, to a web page in Iberclear's site (a 'link'). The establishment of a link will always be directed to the main Home Page of IBERCLEAR and does not imply under any circumstances the existence of relations between IBERCLEAR and the owner of the place or web page from which the link was established, neither the acceptance by IBERCLEAR of the linked place or web page's contents or services. IBERCLEAR reserves the right to prohibit or to render useless at any moment any link to the Home Page, especially when there is suspicion of illicit activity or contents on the web page from where the link originated.
HYPERTEXT LINKS: May be made available on the Iberclear website which allows the User access to websites outside of the Iberclear web domain control. Such hyperlinks are permitted to be used exclusively for the search of information, contents and available services on the internet, but Iberclear does not offer any service associated with the hyperlink nor will be considered responsible for any service as a result of the hyperlink. Once the User has left the boundaries of the Iberclear web domain, Iberclear will not be held, in any circumstances, responsible for the content of the third party website to which the User has been sent, nor will the existence of a hyperlink between Iberclear and a third party website constitute, in any form, a relationship between Iberclear and the third party. Once the User has navigated beyond the Iberclear website the User will be solely held responsible for their actions on the internet and will not hold Iberclear accountable for any occurrence. 4.- PERSONAL DATA POLICY AND PROCESSING
IBERCLEAR undertakes to respect the confidentiality of any personal data provided by the visitors to the website in accordance with the Organic Law 15/1999 of 13 of December, of Personal Data Protection, and other applicable legislation. Visiting the website does not automatically register personal data of any form that could be used to identify a User. Nevertheless, certain non identifiable and non personal User information may exist and may be collected and remain stored on the IBERCLEAR server for the sole purpose of improving the navigation experience of the User and for enhancing the management of the website.

IBERCLEAR is committed to fulfilling its obligation to secrecy of the User's personal data and will treat it with confidentiality, and will take the necessary organisational and technical measures to ensure the necessary security to avoid their alteration, loss, processing or unauthorised access, in accordance with the Organic Law 15/1999 of 13 of December, of Personal Data Protection, and other applicable legislation.
The User will be responsible, in all cases, for the validity of the data input, IBERCLEAR reserves the right to exclude the User from any services should the User knowing falsify their registration, and do so without damage to the other actions that proceed in Right.
Any User registered is able at any moment to exercise the right to agree, to rectify and to cancel its personal data of character supplied, by means of written petition addressed to IBERCLEAR, (Department Organisation), Plaza de la Lealtad, 1, 28014 Madrid, Spain.
